ABSTRAK Skripsi ini berjudul “Tinjauan Hukum Islam dan Peraturan Menteri Ketenagakerjaan Nomor 44 tahun 2015 Terhadap Sistem Jaminan Sosial Tenaga Kerja Harian (Studi Kasus di PT Indokon Raya Sidoarjo)”.Penelitian ini berawal dari pentingnya jaminan sosial bagi para pekerja harian suatu proyek yang mengalami kecelakaan kerja. Dan ketika apabila pekerja harian proyek mengalami kecelakaan kerja memberikan ganti rugi atau santunan dalam bentuk jaminan sosial maka hal tersebut sesuai dengan Peraturan Menteri Ketenagakerjaan Nomor 44 tahun 2015. Padahal dalam Peraturan Menteri Ketenagakerjaan Nomor 44 Tahun 2015 sudah dijelaskan bahwa pemberi kerja atau penyedia jasa konstruksi wajib mendaftarkan pekerja ke Badan Penyelenggara Jaminan Sosial Ketenagakerjaan. Dan mengenai jaminan sosial yang operasionalnya sama dengan asuransi sosial telah di atur dalam hukum islam. Metode yang digunakan dalam penelitian ini adalah studi lapang (Case Study or field research), dengan sifat penelitian deskriptif analisis.. pendekatan yang digunakan adalah dengan wawancara, observasi, dokumentasi berdasarkan hasil penelitian lapangan dengan melihat permasalahan. Maka dapat ditarik kesimpulan bahwa pelaksanaan sistem jaminan sosial tenaga kerja harian apabila ditinjau dengan hukum islam sudah sesuai. Meskipun dalam pengambilan hak manfaat jaminan masih mengandung unsur maisi>r . Sedangkan apabila di tinjau berdasarkan Peraturan Menteri Keteneagakerjaan Nomor 44 Tahun 2015 tentang jaminaan sosial tenaga kerja harian sudah sesuai dengan teori jaminan sosial tenaga kerja harian. ABSTRACT This thesis entitled "Review of Islamic Law and Regulation of the Minister of Manpower No. 44 of 2015 Against the Social Security System of Daily Workers (Case Study at PT Indokon Raya Sidoarjo)." This study originated from the importance of social security for daily workers of a project that had an accident . And when, if the worker of the project worker gets work accident in compensation or compensation in the form of social security then it is in accordance with Regulation of the Minister of Manpower Number 44 year 2015. Whereas in Regulation of the Minister of Manpower Number 44 Year 2015 has been explained that the employer or provider of compulsory construction services registering workers to the Employment Agency for Social Security Employment. And on social security whose operational is the same as social insurance has been regulated in Islamic law. The method used in this study is a field study (Case Study or field research), with the nature of descriptive analysis research .. approach used is by interview, observation, documentation based on field research results by looking at the problem. So it can be concluded that the implementation of the system of social security of daily labor if reviewed with Islamic law is appropriate. Although the right to collect the benefits still contains the elements of the maisi> r. Meanwhile, when reviewed based on Regulation of the Minister of Manpower No. 44 of 2015 on social guidance of daily labor is in accordance with the theory of social security of daily labor.
