    Abstraksi

    Pekerja harian lepas sangat dibutuhkan oleh perusahaan, perusahaan perkebunan kelapa sawit merupakan perusahaan yang paling banyak menyerap pekerja harian lepas.Pelaksanaannya berdasarkan pada perjanjian kerja yang dibuat antara pekerja dan pengusaha, yang memuat hak dan kewajiban sebagaimana diatur dalam peraturan perundang-undangan, pelaksanaanya akan selalu menjadi kajian apakah pemenuhan hak-hak pekerja harian lepas dilaksanakan sesuai peraturan perundang-undangan atau tidak. Penelitian ini menggunakan jenis penelitian empiris (applied law research) yang berangkat dari ketentuan hukum positif yang diberlakukan pada peristiwa hukum(in concreto) dalam masyarakat sehinga dalam penelitiannya selalu terdapat dua kajian, pertama kajian tentang hukum positif (law in book) yaitu tentang pelaksanaan perjanjian kerja harian lepas beserta hak dan kewajibannya, dan kedua kajian tentang keberlakuannya (law in action) mengenai pelaksanaan perjanjian kerja harian lepas beserta pemenuhan hak-hak dari pekerja harian lepas. Hasil dari penelitian ini menunjukkan bahwa pelaksanaan perjanjian kerja harian lepas terdapat banyak aturan yang tidak dilaksanakan pengusaha. Terdapat diskriminasi jenis pekerja, dimana hak-hak dasar sebagai pekerja tidak diberikan kepada pekerja harian lepas. Pada pelaksanaan perjanjian kerja harian lepas, banyak prosedur yang tidak dilakukan oleh pengusaha yang mengakibatkan perubahan jenis perjanjian kerjanya menjadi perjanjian kerja tetap, tetapi hal tersebut tidak pernah dilaksanakan oleh pengusaha.     Abstraction

    Non permanent employee is needed more in business, oil palm plantation company is one of company which absorb for freelance. The realization based on the employment agreement which is maked among employee and entrepreneur, includes rights and obligations such as the realization which arranged by legislation. Beside, the realization always became a study what is fulfillment of freelance is done based on the rule of legislation or not. This study used kinds of empirical research (applied law researh) which is leaved by provision positive law and which is enacted law event (in concreto) in society, with the result that is this study always exist of two study. First, the study about law positive ( law in book) it is described as the realization freelance agreement including rights and obligations. Second, this study about law in action, it is described as the realization freelance agreement including fulfillment right from freelance. The results of this study showed that, the realization of non permanent employee agreement find out there are many rules are not doing by entrepreneur. There are find kinds of discrimination where is the basics of right as a employee is not given to an not permanent employee. The realization in this not permanent employee agreement, there are many procedures is not done by entrepreneur, the efects showed a changed kinds of the work agreement became permanent employment agreements, the realization is never done by entrepreneur Keywords: Non Permanent Employee, A Fulfillment of Rights, A Change of Work Agreement Types
