    Abstraksi

    Penelitian ini menganalisis terkait perlindungan hak pekerja di Indonesia dan perluasan fungsi korporasi yang layak dibebani tanggung jawab dalam perlindungan hak pekerja. Perlindungan terhadap hak pekerja saat ini banyak negara telah meratifikasi konsep United Nations Guiding Princilpe on Bussines and Human Rights (UNGP) yang mempunyai tiga pilar yaitu proctect, respect dan remedy dengan meletakan tanggung jawab selain kepada pemeritah juga kepada korporasi. Korporasi dibebankan tanggung jawab karena merupakan subjek hukum ketenagakerjaan di Indonesia, konsep tanggungjawab telah mengalami perluasan makna dimana tanggungjawab dapat dibebankan hanya dengan ada atau tidaknya kerugian yang dirasakan oleh subjek hukum. Penelitian ini menggunakan jenis penelitian empiris di PT.Yanaprima Hastapersada dengan metode pendekatan fakta (fact approach) dan perundang-undangan (Statue Approach). Tanggungjawab korporasi di Indonesia hanya mewajibkan korporasi dalam pemberian hak sesuai instrument hukum. Konsep tanggungjawab yang dibebankan kepada korporasi selaku subjek hukum ketenagakerjaan belum diatur di Indonesia dikarenakan didalam semua instrument hukum ketenagakerjaan tanggungjawab perlindungan hak pekerja dibebankan kepada negara. Pelaksanaan konsep tanggungjawab korporasi terhadap perlindungan hak pekerja di PT.Yanaprima Hastapersada terdapat perbedaan perlindungan hak pekerja antara pekerja kontrak dengan pekerja tetap. PT.Yanaprima Hastapersada hanya menjamin perlindungan terkait BPJS terhadap pekerja kontrak sedangkan pekerja tetap semua hak yang terdapat di dalam UU Ketenagakerjaan dijamin oleh korporasi.     Abstraction

    This study analyzes related to the protection of workers 'rights in Indonesia and the expansion of decent corporate functions charged with the responsibility in the protection of workers' rights. The protection of workers' rights today many countries have ratified the United Nations Guiding concept Princilpe on the Business and Human Rights (UNGP), which has three pillars, namely proctect, respect and remedy by placing responsibility in addition to pemeritah also to corporations. Corporations charged with the responsibility because it is the subject of employment law in Indonesia, the concept of responsibility have expanded the meaning of where responsibility can be imposed only by the presence or absence of loss felt by the subject of the law. This research uses empirical research in PT.Yanaprima Hastapersada to approach facts (fact approach) and legislation (Statue Approach). Corporate Responsibility in Indonesia only requires corporations in granting the right to appropriate legal instrument. The concept of the responsibility imposed on the corporation as the subject of labor law has not been regulated in Indonesia because in all the instruments of labor law protection of workers' rights responsibilities borne by the state. Implementation of the concept of corporate responsibility towards the protection of workers' rights in PT.Yanaprima Hastapersada there is a difference between the protection of the rights of workers with contract workers permanent workers. PT.Yanaprima Hastapersada related BPJS only guarantee protection against contract workers while the permanent workers of all rights contained in the Employment Act guaranteed by the corporation.
