Adakalanya seorang dokter ketika melakukan pekerjaannya mengalami kegagalan seperti salah memberikan resep, atau penulisan yang tidak jelas sehingga sulit dibaca dan dipahami oleh seorang apoteker yang dapat mengakibatkan terjadinya kesalahan pengobatan (medication error), bahkan dapat mengakibatkan meninggal dunia. Berkaitan dengan itulah, perlu dilakukan penelitian tentang tanggung gugat dokter atas kerugian pasien salah obat akibat ketidakjelasan tulisan resep dokter. Jenis penelitian ini merupakan penelitian normatif. Adapun pendekatan yang dilakukan adalah pendekatan perundang-undangan. Bahan hukum primer dan sekunder dianalisis menggunakan analisis deduktif dan preskriptif. Hasil penelitian menunjukkan bahwa kriteria penulisan resep yang tidak jelas adalah jika tidak sesuai dengan isi Standar Kompetensi Dokter (SKD) pada area tujuh. Substansi pada SKD di area tujuh meliputi tepat indikasi, tepat obat, tepat dosis, tepat frekuensi, cara pemberian yang tepat, sesuai dengan kondisi pasien, jelas, lengkap, dan dapat dibaca. Resep yang sesuai isi SKD pada area tujuh merupakan resep yang bijak dan rasional. Dengan demikian, secara a contrario, resep yang tidak sesuai dengan isi SKD merupakan resep dokter yang tidak jelas dan tidak rasional. Dokter dapat digugat atas kerugian pasien akibat ketidak jelasan tulisan resep dokter karena resep merupakan perwujudan akhir dari kompetensi keahlian dokter dalam menerapkan pengetahuannya. Oleh karena itu, tanggung gugat dokter atas kerugian pasien akibat ketidak jelasan tulisan resep dokter bersifat mutlak. Kata kunci : tanggung gugat, dokter, resep tidak jelas

In this regard, it is necessary to conduct a research on the accountability of physicians for the loss of the wrong patient due to the unclearness of the doctor's prescription. This type of research is a normative study. The approach taken is the approach of legislation. Primary and secondary legal materials were analyzed using deductive and prescriptive analysis The results of the study indicate that the unclear criterion of prescriptions is if not in accordance with the contents of the Doctor Competency Standard (SKD) in area seventh. The contents of SKD in the seventh area include precise indications, precise medication, exact dosage, appropriate frequency, appropriate delivery method, According to the patient's condition, clear, complete, and legible. The recipes that fit the contents of SKD on area seven are wise and rational recipes. Thus, a contrario, a recipe that is inconsistent with the contents of the SKD is an unclear and irrational prescription. Doctors may be sued for the patient's loss due to the vagueness of prescribed docs because the recipe is the ultimate manifestation of the physician's competence in applying his knowledge.
