Perlindungan Hukum terhadap Petugas Administrasi menurut UndangUndang Nomor 13 Tahun 2003 tentang Ketenagakerjaan mencakup kedudukan Petugas Administrasi dengan tugas Tenaga Pendamping di Dinas Pemberdayaan Masyarakat dan Desa Metode dalam penelitian ini menggunakan metode penelitian hukum yuridis empiris, dengan metode pendekatan masalah menggunakan perundangundangan Hasil penelitian ini menunjukkan bahwa Kedudukan Petugas Administrasi dengan tugas Tenaga Pendamping menurut ketentuan Pasal 56 ayat 2 UndangUndang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan bahwa petugas Administrasi tersebut adalah tenaga kerja waktu tertentu. Namun, dilihat dari jenis pekerjaannya hal ini bertentangan dengan Pasal 59 ayat 1 Undang-Undang Ketenagakerjaan. Seharusnya dalam perjanjian kerjanya Petugas Administrasi dengan tugas tenaga kerja pendamping lebih diperjelas atau disebutkan sebagai tenaga kerja waktu tertentu
AbstractionLegal protection of administrative officer according to law Number 13 of 2003 concercing manpower includes the position of administrative officer with the task of assisting personel in the Community and Village Empowerment Office of the Pamekasan Regency. To employ assistant in a manner that is not in accordance with applicable regulations. In Article 59 of Law Number 13 of 2003 related to that, the problem examined in this thesis is how the legal position of the administrative officer with the task as a companion is based on the labor law and how the legal protection of the law. The method in this research is empirical juridical law research method, using statue apporoach method, and analysis of legal meterial used is descriptive analysis technique. The results of this study indicate that position of administrative officer with the task of accompanying personnel according to the provisions of article 56 paragraph 2 of Act Number 13 of 2003 concerning manpower that the administrative officer is a certain time labor. However, judging from the type of work it is contrary to article 59 paragraph 1 of the labor law. In the agreement, the administrative officer with the task of the accompanying workforce is more clearly or mentioned as a certain time workforce. And the legal protection of administrative officer with the duties of assistants in the Community and Village empowerment officer of Pamekasan Regency is not in accordance with what has been determined by the labor law. Workers should get proper wage and welfare protection such as social security protection, health and safety protection.
