    Skripsi yang berjudul Tinjauan Hukum Islam Terhadap Pelaksanaan Akad Sewa Kamar Kos (Studi Kasus Perumahan Telang di Kecamatan Kamal Kabupaten Bangkalan), berlatar belakang kasus yang timbul dari transaksi sewa menyewa yang ada di kalangan mahasiswa, dimana sistem praktik pembayaran kamar kos yang tidak sesuai dengan pernyataan pada akad yang disepakati yaitu, tentang penggunaan pembayaran kamar kos yang tidak sesuai akad yang disepakati. Rumusan masalah dalam penelitian ini, Bagaimana Pelaksanaan Akad Sewa Kamar Kos Mahasiswa di Perumahan Telang, Kecamatan Kamal, Kabupaten Bangkalan dan Tinjauan Hukum Islam Terhadap Pelaksanaan Akad Sewa Kamar Kos Mahasiswa. Penelitian ini bertujuan untuk mengetahui bagaimana pelaksanaan akad sewa kamar kos mahasiswa di Perumahan Telang, Kecamatan Kamal, Kabupaten Bangkalan serta mengetahui tinjauan hukum Islam terhadapnya. Pada penelitian ini, peneliti menggunakan metode penelitian kualitatif dengan sifat penelitian normatif empiris dengan pendekatan studi kasus (Case Study Research). Teknik pengumpulan data dalam penelitian ini menggunakan observasi, wawancara, dan dokumentasi kemudian data dianalisis secara deskriptif analisis. Hasil penelitian dalam penelitian ini adalah Pelaksanaan sewa kamar kos menggunakan akad ijarah (sewa menyewa) ini sudah sesuai dengan ayat al-Quran, pendapat imam madzhab dan rukun-rukun akad. Sedangkan berdasarkan hadits, hak dan kewajiban, serta syarat sahnya ijarah dalam fiqh muamalah tidak sesuai dikarenakan terdapat unsur terpaksa dan kerugian yang dialami penyewa kamar kos disebabkan ada tambahan pembayaran diluar akad/perjanjian. Akad ijarah yang terdapat pada praktik sewa kamar kos dapat dibatalkan karena dipertegas dalam KHES, Pasal 301 yang berbunyi “Apabila salah satu syarat dalam akad ijarah tidak ada, maka akad itu batal”.

    Abstraction

    The study entitled Islamic Law Review on the Implementation of the Contract of Boarding Room Rental (A Case Study on Telang Housing in Kamal Sub District Bangkalan Regency) has a background of the cases that arising from lease transactions among students that the practice system of boarding room payment does not comply with the statement on the agreed contract, such as the use of boarding room payment which is not accordance with the agreed contract. The statements of the problem of this study are: How is the Implementation of the Contract of Students Boarding Room Rental in Telang Housing, Kamal Sub district, Bangkalan Regency and the Islamic Law Review on the Implementation of the Contract of Students Boarding Room Rental. The aims of this study are to know how the implementation of the contract of students boarding room rental in Telang Housing, Kamal Sub District, Bangkalan Regency and to know the review of Islamic law on it. This study uses qualitative research method with normative empirical research and case study approach. Technique of collecting data in this study uses observation, interview, and documentation which then the data are analyzed by descriptive analysis. The results of this study are the implementation of boarding room rental which uses contract of ijarah (lease) is in accordance with the verses of the Qur’an, the opinion of imam madzhab, and the pillars of contract. On the other hand, it is not accordance with hadith and fiqh muamalah because there are elements of forces and losses which suffered by tenant of the boarding room due to the additional payments beyond the contract/agreement. The contract of ijarah in boarding room rental can be cancelled because it is reinforced in KHES, Article 30 which reads “If any of the terms in the contract of ijarah does not exist, then the contract was cancelled.” Keywords: Ijarah, Practice, Contract, Boarding Room Rental.
