    Abstraksi

    Penjualan minuman beralkohol sudah diatur dalam KUHP dan dilarang untuk menjual dan mengkonsumsi karena dapat membahayakan kesehatan tubuh dan bisa kecanduan, terutama bagi golongan remaja yang masih labill jiwanya, tetapi masyarakat tetap saja menjual dan mengkonsumsinya diantaranya masyarakat Kabupaten Pamekasan. Skripsi ini bertujuan untuk mengetahui faktor ketidakefektifan Peraturan Daerah Nomor 18 Tahun 2001 tentang Larangan Atas Penjualan Minuman Beralkohol Dalam Wilayah Kabupaten Pamekasan. Jenis penelitian skripsi ini adalah penelitian hukum empiris. Yaitu penelitian yang didasarkan oleh fakta, realita dan permasalahan yang ada di lapangan Jenis penelitian ini dipilih karena langsung melakukan penelitian ditengah-tengah masyarakat untuk mengetahui proses bekerjanya hukum didalam masyarakat, efektifitas dan tingkat kesadaran masyarakat dalam menaati hukum. Sumber data yang digunakan adalah data primer dengan mengadakan wawancara terhadap Kepolisian Pamong Praja dan masyarakat yang menjual Minuman Beralkohol dan data sekunder yang diperoleh melalui studi kepustakaan dengan membaca sumber-sumber yang berkaitan dengan permasalahan penelitian. Hasil penelitian menunjukkan bahwa faktor-faktor yang mempengaruhi ketidakefektifan Perda Nomor 18 Tahun 2001 tentang Larangan Atas Penjualan Minuman Beralkohol Dalam Wilayah Kabupaten Pamekasan antara lain : 1). Faktor undang-undang. 2). Fakto penegak hukum. 3). Faktor sarana atau fasilitas. 4). Faktor masyarakat. 5). Faktor budaya hukum. Adapun faktor yang dominan dari beberapa faktor tersebut masalah ketidakefektifan Peraturan Daerah Nomor 18 Tahun 2001 tentang Larangan Penjualan Minuman Beralkohol di Kabupaten Pamekasan adalah faktor masyarakat yang masih berjualan dikarenakan ekonomi dan karna banyak peminatnya.     Abstraction

    Sale of alcoholic beverage has been regulated in the KUHP and it is forbidden to sell and consume because it can be harm the health of the body and can be addictive, especially for groups of teenagers who still blue but people still sell and consume it such as the society of Pamekasan Regency. This thesis aims to know the ineffectiveness of Regional Regulation No. 18 of 2001 about the Prohibition of the sale of Alcoholic Beverage around Pamekasan regency. This type of this thesis is empirical law research. It was based on fact, reality and the existing problem on the field. The types of the research have been selected because it is directly conducting the research among the people to know the workings of law in society, the effectiveness and the level of society’s awareness in obeying the law. Source of data uses primary data by conducting interviews with the Police Civil Service and the society who selling the Alcoholic Beverages and secondary data are obtained through the library research by reading the sources which are related to the research problems. The results showed that the factors that influence the ineffectiveness of regional regulation No. 18 of 2001 about the sale of Prohibition of Alcoholic Beverage around Pamekasan regency, they are: 1). Legislation factors. 2). law enforcement factors. 3). Tools or facilities Factor. 4). Community factors. 5). Law culture factors. The dominant factors are the problem of ineffectiveness Regional Regulation No. 18 of 2001 about the sale of Prohibition of Alcoholic Beverage around Pamekasan regency is society who still selling because of the economy and have much demand.
