    Kebebasan beragama adalah bagian yang tidak terpisahkan dari konsepsi Hak Asasi Manusia tentang kebebasan berpikir dan mengemukakan pendapat. Kebebasan beragama telah nyata diatur dalam ketentuan Pasal 28 E ayat (2) Undang-undang Dasar 1945, bunyi pasal tersebut ialah bahwa Setiap orang berhak atas kebebasan meyakini kepercayaan, menyatakan pikiran dan sikap, sesuai dengan hati nuraninya. Pasal ini lebih tegas lagi menyatakan bahwa kebebasan beragama tidak bisa dipisahkan dari kebebasan untuk meyakini kepercayaan, menyatakan pikiran dan sikap sesuai dengan hati nuraninya. Kebebasan beragama juga diatur dalam ketentuan The Declarations on the Eliminations of All Froms of Intolerance and of Discriminations Based on Religions or Belief Proclaimed by General Assembly Resolutions 36/55 of 25 November 1981. Dalam perkembangannya, terdapat beberapa konflik yang didasari oleh perbedaan agama dan keyakinan seperti kasus yang menimpa Tajul Muluk yang dihakimi warga setempat karena diduga menyebarkan aliran syiah yang menurut pandangan masyarakat setempat aliran tersebut merupakan aliran sesat. Pernyataan sesat itulah yang menyebkan Tajul Muluk berurusan dengan hukum. Selanjutnya dalam putusan pengadilan negeri Sampang Majelis menjatuhkan pidana terhadap Tajul Muluk dengan berupa pidana penjara selama 2 tahun dikarenakan terbukti melanggar ketentuan tindak pidana penodaan agama Islam sebagaimana dalam dakwaan kesatu melanggar pasal 156A Kitab Undang-Undang Hukum Pidana (KUHP). Putusan tersebut oleh beberapa kalangan dianggap telah menciderai prinpsip-prinsip Hak Asasi Manusia dan ketentuan The Declaratioans By General Assembly Resolutions 25 November 1981.

    Abstraction

    The Freedom of religion is an integral part of the concept of Human Rights on freedom of thought and expression. Freedom of religion has been explicitly stipulated in the provisions of Article 28 E paragraph (2) of the Constitution of 1945, the content is that everyone has the right to freedom of belief to believe, express thoughts and attitudes, in accordance with his conscience. This article more pointedly states that freedom of religion can not be separated from the freedom to believe in belief, states of mind and attitude in accordance with his conscience. Freedom of religion is also stipulated in the Declarations on the eliminations of All froms of Intolerance and of Discriminations Based on Religions or Belief Proclaimed by General Assembly Resolutions 36/55 of 25 November 1981. In development, there are some conflicts based on religious differences and beliefs such as the case of a judgment Tajul Muluk local residents for allegedly spreading Shiite streams that flow in the eyes of the local community is a cult.
